CONDITIONS of SALE
Emmons Auction and Realty makes every attempt to uphold the highest standards in the auction industry. Our goal is to consistently deliver quality merchandise and services to our customers. The descriptions of merchandise represent what we have deemed appropriate to identify each object. While we make all efforts to be accurate, Buyer agrees that in no event shall Emmons Auction and Realty be responsible for the correctness, description, genuineness, authorship, attribution, provenance, period, culture, source, origin, value, or condition of any lot. However, all items are sold as is, where is, without any warranty expressed or implied by Emmons Auction and Realty.
1) It is the bidder’s responsibility to inspect, research, and determine the authenticity of all items on which bids are placed. Determination of age, materials, condition, quality, authenticity, classification, purported history and perceived value, regardless of what is written or said by the owner or Emmons Auction and Realty.
2) If you are not able to make what you consider to be a comfortable decision about an item or if you believe an item may be incorrectly portrayed in our catalog, we suggest that you not bid on the item.
3) All sales are final and are non-returnable. It is important that you pay for and acquire your item in a timely fashion. When you have the winning bid, the item(s) become the buyer’s property.
4) No Chargeback Policy - Purchasers agree that disputes of any nature may not be resolved by a credit card chargeback and further agree to refrain from filing any chargeback claim against Emmons Auction and Realty and/or its credit card merchant. By purchasing with us, the purchaser waives the right to initiate a chargeback and furthermore agrees to pay a minimum of $500 plus administrative fees, attorney fees, and/or any other charges associated with responding to said chargeback.
GENERAL INFORMATION
Bidder recognition: The auctioneer shall only accept bids from properly registered bidders. The winner of the bid will go to the highest and best bid as determined by auctioneer.
Emmons Auction and Realty reserves the right to withdraw any lot at any time from the auction for any reason.
Emmons Auction and Realty may reject or refuse to accept any bid or bidder that may be deemed inappropriate for any reason.
Emmons Auction and Realty will honor the right of the seller to set a reserve on items presented to sell.
Bidder must be at least 18 years of age or older and of good creditworthiness.
The buyer’s premium is 10% for all items purchased.
Some items in the auction may be offered subject to a reserve, which is a confidential, minimum price, below which the item cannot be sold.
Online bidders must follow the registration steps required by the applicable bidding platform and are subject to both the terms and conditions of the online bidding company and Emmons Auction and Realty. Bidders must agree to receive email about upcoming events from Emmons Auction and Realty. Emails will be used solely for information by EAR and not shared.
PAYMENT
Successful live bidders are expected to pay in full for all purchases immediately following the auction.
Online bidders will be notified of their purchases by email within 5 business days of the auction. Payment is due no later than 10 days post sale. Payment for packing and shipping is covered under the “Shipping” section.
All payments must be in US Dollars. No items will leave Emmons Auction and Realty until payment is made in full.
EAR reserves the right to hold all merchandise until payments clear our bank or credit card.
All returned checks will be assessed a $40.00 processing fee. In the event payment in full is not received within 10 days from the date of the auction, any outstanding amounts will be charged to the credit card on file.
If no credit card is available or if payment has not been received within 10 days, Emmons Auction and Realty will pursue collection avenues. These may include additional charges for storage, administrative, collection, attorney and/or court fees.
If payment is not received 30 days from the sale, there will be a 3% surcharge added to the total invoice.
Sales Tax - The State of Mississippi sales tax is 7% will be assessed on all purchases except when buyer provides a copy of a valid state-issued resale certificate (business type must pertain to the item/s being purchased.
SHIPPING
Emmons Auction and Realty does not provide shipping services for large items at this time. We are happy to provide shipping of smaller items at the best possible price. We utilize the United States Postal Service unless the item(s) can be shipped cheaper through another shipping media.
Bidders have the responsibility to pay all shipping and handling fees including insurance.
If you are planning to pick up your property that may be too large to ship from Emmons Auction and Realty, please call 48 hours in advance to make arrangements.
